Terms of Service

These terms cover your use of Lotfence at lotfence.com. By using Lotfence or buying a Seat, you agree to them. If you don't agree, don't use Lotfence.

Who we are

Lotfence is made by Van Interactive, Winter Garden, FL ("we", "us"). You can reach us at support@lotfence.com.

Who Lotfence is for

Lotfence is a takeoff and estimating tool for fence contractors in the United States. You must be at least 18 and using Lotfence for your business.

What Lotfence does

You upload a property survey (plat), set the scale, trace the fence outline, enter your rates, and Lotfence works out quantities and a priced Estimate you can print or download. You can use the takeoff tools without paying.

The Seat

• What it is. A Seat is a one-time payment of US $249 for one year (365 days) of Seat features for one contractor shop. Right now, a Seat puts your Shop name, shop logo, and shop contact block on your Estimates and PDFs in place of Lotfence branding. We may add Seat features over time.
• No auto-renew. We charge you once. We don't store your card or charge you again. When your Seat ends, your Estimates go back to showing Lotfence branding (your saved Shop name, logo, and contact details stay in your browser), and you can buy a new Seat if you want one.
• Seat key. After checkout, Lotfence saves your Seat key in your browser on that device and emails it, through Resend, to the address you used at checkout. You can see and copy it in Contractor Settings; keep a copy somewhere safe. To use your Seat on another browser or device, paste the key into Contractor Settings.
• One shop. A Seat is for one contractor business. You can use the key on your shop's own devices. Don't share it outside your shop, post it publicly, or resell it. Keep it safe like a password; anyone who has the key can use it.
• Lost key. Email support@lotfence.com from the address you used at checkout and we'll help.
• Payments are handled by Stripe. Prices are in US dollars. We don't collect sales tax at this time.
• Refunds are covered by our Refund Policy.

Your estimates are your responsibility

Lotfence makes estimates from a plat that you upload, scale, and trace. It is not a survey, and it doesn't find property lines, easements, setbacks, utilities, or slopes. Quantities are only as good as the plat and your scale and tracing.

You are responsible for:

• checking measurements and quantities on site,
• confirming property lines, and any HOA or local rules,
• getting any permits you need, and
• the prices, bids, and contracts you give your customers.

Every Estimate includes this notice: "This takeoff is not a professional survey. Quantities come from the uploaded plat as traced and scaled by the contractor. Verify on site."

Your content

Your plats, Jobs, rates, Shop name, shop logo, shop contact details, and Estimates are yours. Lotfence works on them in your browser and keeps them in your browser's storage on your device. We don't claim any ownership of them. Make sure you have the right to use any plat you upload.

Acceptable use

Don't:

• break the law or anyone else's rights using Lotfence,
• try to break, overload, or get around Lotfence's security or the Seat key system,
• copy, resell, or rebrand Lotfence itself, or
• use Lotfence to mislead customers, for example by presenting a Lotfence Estimate as a professional survey.

We may stop providing Lotfence to anyone who breaks these terms. We may also refuse or cancel a Seat for abuse or fraud.

Changes to Lotfence

We may change, add, or remove features. If we shut Lotfence down while your Seat is active, we'll give you a prorated refund for the unused part of your Seat.

No warranty

Lotfence is provided "as is" and "as available." As far as the law allows, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't promise Lotfence will be error-free or always available. Browser storage can be cleared or lost, so keep copies of Estimates you need.

Limitation of liability

As far as the law allows:

• We aren't liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost bids, or lost data.
• Our total liability for any claim about Lotfence is capped at the amount you paid us for Lotfence in the 12 months before the claim.

Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts in Orange County, Florida.

Changes to these terms

We may update these terms. We'll change the "Last updated" date at the top and post the new terms here. If you keep using Lotfence after a change, you accept the updated terms. Changes don't affect a Seat you've already paid for.
